1. SCOPE OF ACTIVITY
Viavue Travel Incorp , is a professional Marketing company and Out Bound Tour Operators. We do not have direct control over any suppliers and do not own any hotels, airlines, restaurants, cruises or coaches. Circumstances beyond our control like major road works, traffic congestions, weather conditions, conventions, fairs, festivals, sport events, political/religious gatherings, strikes, change of management/closure of hotels/restaurants, over booking of hotels/flights, cancellation/ re-routing of flights or railway, closure of / restricted entry at a place of sightseeing and any other circumstances not mentioned herewith may result in cancellations / changes in the services / itineraries. Therefore, we reserve the absolute right to alter, amend, change, modify or even cancel the tour package, itineraries, tour schedule, travel plan, tour arrangements and/or sightseeing locations. Where we may know of these sufficiently in advance we will notify you, otherwise our tour managers or local representative/s will inform you of the changes on the spot. Since there are big conventions, fairs, exhibitions, etc. lasting over extended periods of time, in some cities, when all the hotels are fully booked, well in advance , though every effort is made to avoid such dates, in the few instances where it is unavoidable, it may be necessary to stay in hotels in other cities. You would be advised of this in advance, as far as possible.

2. PAYMENT
Payments should be made in the name of M/s. Viavue Travel Incorp by cheque or DD preferably. In unavoidable circumstances, cash payments are accepted. We also accept credit cards. There will be a surcharge of 2% on card payments which will be added to the total invoice cost.

2(a) ROOM / FLIGHT /CAB / CRUIES Booking Only - For bookings which are made within 7(Seven) working days of Booking, the full amount will become immediately payable either by DD, CASH or CREDIT CARD ONLY.

2(b) TOUR Booking Only - For bookings which are made within 10 (ten) working days of tour departure, the full amount will become immediately payable either by DD, CASH or CREDIT CARD ONLY.

3. BALANCE
Once the completed Booking Form and the advance have been received an invoice will be issued, along with a receipt for the money already paid. The full payment towards the cost of the Room Tariff /Tour must be paid at least 20 (twenty) days prior to tour departure Or Room Stay. Failure to pay the balance within the specified period will result in the cancellation of the booking, and the cancellation charges as detailed below will become applicable on the booking.

4. IF YOU CANCEL YOUR STAY or HOLIDAY
If you or any member of your party wishes to cancel your/their Stay or Holiday, for any reason whatsoever, you must notify us in writing only. In any case, the date of cancellation will be at the date on which notice is received by us. The person who Book by E-Mail or Signed the confirmation form must also sign the letter of cancellation or its Policy . As this incurs administrative costs and we may not be able to resell your booking, cancellation charges will apply on the following scale: In all cases the below mentioned cancellation fees, will be applicable in INR.

5. FORCE MAJEURE
We shall not be liable for failure to perform any of our obligations hereunder and we shall not be liable to pay you compensation if we have to cancel or change your travel arrangements in any way as a result of unusual or unforeseeable circumstances beyond our control. In addition to the items mentioned in point 1 in this schedule of terms and conditions, these unusual and unforeseen events include but are not limited to war, civil disturbance, riot, strike, industrial dispute, terrorist activity and its consequences, natural or nuclear disaster, fire, earthquake, volcano eruptions, adverse weather conditions or by any other cause beyond our control. If in the unlikely event of your tour being cancelled by us, we will repay the money after deducting the expenses incurred in organizing the said tour and refund the balance within 15 (fifteen) working days from the date of cancelling the tour. Our decision on the amount to be deducted in such circumstances is final.

6. IF YOU CHANGE YOUR BOOKING
If, after your confirmation, an invoice has been issued and you wish to change your travel arrangements in any way, for example your chosen departure date, names of passengers or accommodation, we will do our utmost to make these changes, but it may not always be possible. Any request for changes to be made must be in writing from the person who made the booking. You may also be asked to pay an administration charge on a per person/ per change basis and any further costs we incur in making this alteration. You should be aware that these costs could increase closer to the departure date that changes are made and you should contact us as soon as possible if any change is required.

7. BOOKING / TRAVEL DOCUMENTS AND CLEARANCES (International or Domestic)
It shall be your sole responsibility to hold valid travel documents and statutory clearances, to enable you to travel on the tour, including without limitation, passports, valid visa, insurance and medical insurance certificates and other statutory certificates such as immigration clearance, as may be applicable. Please note that for all international travel, your passport must be valid for at least six months subsequent to the scheduled departure date of the tour.

As granting or rejecting visas and immigration clearance is the sole prerogative of the concerned sovereign governments, we shall neither be responsible in case of non-granting of such documents nor liable for any delay, denial or other related act/omission or for any loss, expense, damage or cost resulting there from. The position with respect to cancellation of the tour by you due to non-availability of travel documents would not change only by virtue of you having applied for such documents through us. Even if visas are rejected and/or required travel documentation is not obtained for any reason whatsoever, our stipulated fees shall be payable by you. There will be no refund, if you or any member of your Group is unable to travel due to the said reasons. In such cases, the advance paid by you shall be forfeited and no claim whatsoever shall be made for the same.

In the event that you or a member of your group is unable to travel on the tour originally booked by you, due to rejection of visas by the concerned embassy, you shall have the option to postpone your tour to any other future date or transfer your tour to any other tour package offered by us. In such case, the transfer fee for the transfer of the tour shall apply. However, if you book and pay within the cancellation period and are unable to travel due to any reason whatsoever including non-availability of visas or any travel documents, the cancellation policy will apply.

8. LIMITATION OF LIABILITY
We or our agents shall, to the maximum extent permitted by law, not be liable for any indirect, incidental, consequential, special, exemplary or punitive damages, injury, loss, delay, expense, inconvenience suffered as a consequence of, arising out of, or, relating to this agreement or carrying out of the tour and the rendered contractual travel services, whether such claim is based on warranty, contract, tort (including negligence), statute or otherwise (even if we or our agents have been advised of the possibility of such damages). This limitation of liability will apply whether the damages arise from use or misuse of or reliance on the service, or from the interruption, suspension, malfunction, or termination of the service. There is no limitation of liability for damages caused through our intention or culpable negligence, resulting in death or personal injury. We however recommend that you and your group procure personal and travel insurance. Further, under no circumstances shall our or our agent’s liability for any direct damages exceed the total charges paid to us hereunder.

9. LAW & JURISDICTION
This agreement shall be governed by the laws of India. All complaints, suits, claims or disputes of whatsoever nature relating to or arising here from shall be subject to the exclusive jurisdiction of the courts in Bangalore, India, alone.
